Before using or subscribing to Golden Trumpet, LLC's services, please review the following terms and conditions (the Agreement) which define your rights, responsibilities and benefits as a user of Golden Trumpet, LLC's services - last updated 04/20/2008.

USER-PROVIDED CONTENT

Portions of the Service will contain user-provided content to which you may contribute appropriate content. By submitting content to Golden Trumpet, LLC, you grant Golden Trumpet, LLC a license to the content to use and host that Content to the extent and in the form or context we deem appropriate. You should submit only content which belongs to you and will not violate the property or other rights of other people. We will not edit or monitor user-provided content, with the exception that we reserve the right to remove any user-provided content that comes to our attention and that we believe, in our sole discretion, is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred or violates the rights of others, or is in any other way objectionable.

LIABILITY DISCLAIMER

The information, products, and services included in this Agreement may include inaccuracies or typographical errors. Changes are periodically made to the information herein. We maintain all Content in this Service "AS IS", and without any warranty of any kind.

Golden Trumpet, LLC makes no representations concerning the suitability, reliability or accuracy of the Content or the service provided on the Service for any purpose. We disclaim all warranties, expressed or implied, in connection with the Content and the services provided on the Service, including conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no case will we be liable for any direct, indirect, punitive, special or other damages including, without limitation, lost or delay of use, lost profits, loss of data or any other damage in contract, tort, equity or any other legal theory, even if advised of the possibility thereof.

SUBSCRIBING MEMBER TERMS

1. REGISTRATION AND SECURITY

1.1 As part of the registration process, you will select a username and password. You must provide Golden Trumpet, LLC with accurate, complete, and up-to-date registration information. Failure to do so will constitute a breach of this Agreement. You understand that you may not (i) select or use a name of another person with the intent to impersonate that person; (ii) use the rights of any person other than yourself without authorization; or (iii) use a name that we, in our sole discretion, deem inappropriate. As you submit information, you understand that the network of Internet Sites ("the sites") including goldentrumpet.com are owned and operated by Golden Trumpet, LLC incorporated in North Carolina, USA. The Sites are operated in the United States of America and operated to be in compliance with the laws of the United States. Access is governed by these terms and conditions under the laws of the State of North Carolina and the United States. Registration as a user of or subscriber to any of the Sites or services provided on them results in your customer information being stored and processed in the United States, and you, in registering or subscribing, specifically consent to that storage and processing. You may access that information at any time to confirm its correctness and to keep it current in connection with your registration or subscription.

1.2 You shall notify us by U.S. mail at: Golden Trumpet, LLC, 4920 Starmount Drive, Greensboro, NC 27410 or by e-mail at: customerservice@goldentrumpet.com of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or billing information. You will be responsible for maintaining the confidentiality of your password. You will never be required to reveal your password to any representative or agent of Golden Trumpet, LLC, its owners or agents.

1.3 You must be 18 years or older to subscribe.

1.4 You are responsible for all usage or activity on Golden Trumpet, LLC via your password account. Distribution of your password to others for access to Golden Trumpet, LLC is expressly prohibited and shall constitute a breach of this Agreement. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and you may be referred to appropriate law enforcement agencies.

1.5 Registered names, addresses and phone numbers can be updated or changed at any time at no cost, as long as the original unit purchase is not exceeded. If you do not have an electronic account, updates and/or change requests must be made to Golden Trumpet, LLC in writing via U.S. Mail.

2. FEES AND PAYMENTS

2.1 All electronic and manual accounts have Lifetime Service Membership. Subscription membership in the Service is on a continuous service basis. This means that once you have become a subscribing member, your subscription will be for your lifetime and your billing choice will be charged accordingly during the initial enrollment. Billing charges will be processed within 24 hours of your order being taken.

3. TERMINATION

3.1 All electronic and manual accounts - You may cancel your subscription by notifying us in writing and obtaining a cancellation number, within 30 days from initial date of activation. After initial 30-day subscription, no refunds will be granted for any reason, except as outlined in Section 4. 

4. MODIFICATIONS TO THIS AGREEMENT AND THE SERVICE

Golden Trumpet, LLC has the right, at its sole discretion, to modify this Agreement or the Service, including the Content of the Service, at any time. Changes in Service will be posted on goldentrumpet.com, or sent via e-mail, or postal mail to you. If any portion of this Agreement or any change of this Agreement of the Service is unacceptable to you or will cause you to no longer be in compliance with the Agreement, you may cancel your subscription by contacting Customer Service in writing at Golden Trumpet, LLC. Continued use of the Service now or following posted notices of changes in this Agreement, (notice is given by changing the date of last revision), means that you have accepted and are bound by the changes. For cancellations for this sole reason after initial 30-day subscription, we will refund to you a minimal calculated unused portion of your subscription payment.

5. NOTIFICATION SERVICES

5.1 Client is responsible for providing and maintaining accurate address and phone number information to Golden Trumpet, LLC. Should an address become undeliverable and/or a telephone number unreachable (as, for example, due to relocations, telephone numbers being disconnected or changed, etc.), you expressly understand and acknowledge that Golden Trumpet, LLC will not be liable to any extent in the event that registered contacts are not notified within the specified timeframe and/or in rare circumstances, are not notified at all.

5.2 GOLDEN TRUMPET, LLC DEATH NOTIFICATION POLICY AND PROCEDURES:
(a) In the event of a subscriber's death, subscriber's identified contact must notify Golden Trumpet, LLC as soon as information is available regarding funeral services, ideally within the first 24 hours following the subscriber's death. Information will be verified with the funeral home prior to notification being made.
(b) Golden Trumpet Telephone Calls will be made within 24 hours of initial notification, according to the following schedule. First Attempt - if no contact is made, voice message will not be left. Second Attempt - if no contact is made, voice message will be left providing instructions to contact Golden Trumpet. If Golden Trumpet does not receive a return call within 6 hours of leaving a voice message, a third and final attempt will be made providing instructions once again to contact Golden Trumpet (should no one be available to answer call). In the event voice mail is not available, no further phone attempts will be made. If there is a registered U.S. mail address, a Golden Trumpet card will be sent.
(c) Golden Trumpet Cards will be mailed within 48 hours of being notified of a subscriber's death. In the event a card is returned "undeliverable", no further attempts will be made.
By using and/or continuing to use this Service, you understand and expressly acknowledge that sometimes non-notification may occur as a result of inaccurate Content or non-responsive contacts. You accept Golden Trumpet, LLC Policy and Procedures in such circumstances to minimize risk of non-notification. By using and/or continuing to use this Service, you also acknowledge that you have reviewed this Agreement and understand and agree to be bound by the contents and Terms & Conditions of this Agreement

6. MISCELLANEOUS

6.1 This Subscriber Agreement is governed by the law of the State of North Carolina, without regard to its principles on conflicts of laws, and the federal law of the United States of America. Any action to enforce this Agreement shall be brought in the federal or state courts located in Greensboro, North Carolina.
